Key Discussion Points
- Replacing General Product Safety Directive (GPSD) in the EU
- Applies to all products that are not covered by their own product-specific regulations (for example, Toy Safety Directive)
- Enforcement officials now have more power to take unsafe and uncompliant products off the EU market
- Risk assessment must be filed and made available for all products placed on EU market
- “Economic Operator” is the stakeholder responsible for product safety compliance, being the point of contact and providing documentation to enforcement officers, and must be situated in the EU
- BPMA members must evaluate their supply chain and determine who will act as the economic operator
- Economic Operator’s name, tradename / mark, EU postal and electronic address must be included on the product
- Where the product does not allow for labelling, information can be provided on packaging or on an accompanying label, however the reasoning for this must be justified to EU officials when queried
- Consider including both UK and EU addresses on all products when selling in both markets
- Northern Ireland is also obligated to EU GPSR
- There is currently no indication from the UK Government that the rest of the UK will adopt GPSR, meaning the UK is still obligated to GPSD (excluding Northern Ireland)
- Non-compliance with GPSR may result in products being removed from the EU market
